Hawk Rent a Car - Hong Kong Rental Terms for travel between 01-Feb-2017 and 31-Dec-2018
An initial, non-refundable deposit will be secured at the time of booking confirmation. Accepted credit cards are Visa and MasterCard.
The balance is to be paid directly to the supplier on arrival.

Reservations will be taken in accordance with Car Groups only, make and model subject to availability only.
Drivers must be minimum 25 years old and maximum age 75 years old , and must possess a valid unendorsed driving license for a minimum period of two (2) years which must be recognized for driving Class 2 vehicles in Hong Kong. The Hirer must meet the standard car hire rental agreement rental terms and conditions as per the Company’s standard Rental Agreement. Failure to meet the standard terms and conditions of a rental will result in the rental being refused. The Hirer and Driver(s) will be bound by the laws governing the hire of the vehicle and any contravention of local laws will be the sole responsibility of the Hirer and Driver(s). Should the local authorities take action against such contraventions the Hirer/Driver(s) shall be solely liable and shall keep the Company absolutely blameless in such incidents.
Reservations will be taken in accordance with the Car Group only. Upon confirmation of any reservation the car make and model will be confirmed accordingly. All vehicles are airconditioned and include a CD player, Car jack and spare tyre.
The Company’s rental vehicles may only be driven within the Special Administrative Region of Hong Kong (HKSAR ) and may absolutely NOT be driven into Mainland China or Macau.
All Hawk Vehicles are covered by a standard general motor insurance policy covering third party property damage or bodily injury or death for up to HK$100 million. Damage excess for each respective Car Group is tabled herein under the Rates Sheet and such Insurance Excesses are for own damage to the rental vehicle and third party damage severally.
CDW (Collision Damage Waiver) is Optional and can be purchased separately in accordance with the Rate Sheet tabled herein. Hawk’s Vehicle Insurance and Collision Damage Waiver DOES NOT cover the following:-
Accidents with animals
Damage to undercarriage
Damage caused by driving on unsurfaced roads e.g., construction sites, jungle tracks, beaches, etc.
Missing items e.g., CD player, hub caps, car jack, spare tyre, mobile charger, etc.
* Fire and Theft may also be covered through purchase of Collision Damage Waiver. In the event of theft the hirer is responsible to lodge a Police Report within 24 hours and the Hirer will be responsible for the excess amount as indicated for the specific model rented.
* Theft Protection does not include the contents of the car.
* The keys of the stolen vehicle must be returned to the Hawk station or personnel.
In the unfortunate event of an accident, particularly if there is bodily injury or death it is mandatory that the Hirer/Driver contact the Hong Kong Police (Dial 999) and also inform the Company (Tel: ++852- 25169822) of the accident. The Hirer will then be required to make an official Statement to the Hong Kong Police and also be required to fill in an Accident Form from the Company detailing the nature of the accident and drawing a small sketch of the incident. Failure to perform these actions may result in all liability protection being voided.
Replacement Vehicles will be provided subject to availability of the same and may not necessarily be either the same make or model although every effort will be made to locate a similar engine capacity. The Company’s terms and conditions of hire shall also automatically apply for any replacement vehicle issued to a Hirer.
A Grace period of 60 minutes will be extended to the Hirer for late return of the Vehicle. Any tardiness over and above the grace period will be subject to charges. Per additional hour is based on the daily applicable rate divided by 5.
EXCESS DAYS / EXTENSION OF RENTAL
The extension or “Excess day” will apply if the hirer wants to extend the rental period from the original booking advice. Should the Hirer wish to extend, it is important that the renting station be advised immediately and the required additional rental deposit paid, so that the insurance cover is extended to cover the additional days. Failure to do so may mean that the Hirer is driving the vehicle without any insurance coverage and is in effect unauthorized to be in possession of the vehicle. Hawk reserves the right to repossess the vehicle from the Hirer without any notice given to the Hirer.
The rental vehicle will be issued with a minimum of a ¼ tank of fuel at the time of delivery of the rental vehicle and should be returned with a similar amount of fuel. In any case of failure to return the rental vehicle with fuel, the Company will refuel the vehicle and add a premium service charge of 50% over and above the actual cost of the fuel.
The Hirer is required to pay a Security Deposit (refundable) and such deposit will be taken against the Hirer’s credit card at the time of collection of the rental vehicle. Such deposit will be returned to the Hirer’s Credit card account six (6) weeks subsequent to the return of the rental vehicle in good order. The Company is hereby expressly authorised to settle any unpaid traffic fines, refuelling costs, damage reinstatement charges incurred by the Hirer by way of deducting such amounts against the Security Deposit held.
DELIVERY AND COLLECTION CHARGES
Any vehicle delivered or collected from a location other than a Hawk office will incur a delivery and/or collection charge depending on the location and the day and time of day.

The Company reserves its rights to “Stop Sell” rentals reservations in any event of nonavailability of rental vehicles.
TERMS AND CONDITIONS
1. Rental rates are to be paid in advance and a deposit (refundable) is required.
2. Rates include Road Tax, Insurance, Full Maintenance, Free Replacement Vehicle (subject to availability), Unlimited Kilometers and First Additional Driver
3.Vehicles include Air-Conditioner, Sound System, Tool Kit and Jack.
4. Rates do not include CDW, Petrol, Parking Fees, Traffic Fines, Tunnel/Bridge tolls and Restricted Zone Permits.
5. Delivery & collection charges may be applicable.
6. Delivery & collection service during office hours will be provided free of charge if rental period is for one week or longer.
7.Security Deposits received will be returned by mail within approximately six weeks after the return of vehicles in good order, less any deductions for damage reinstatement and/or traffic fines (if applicable).
8. The Hirer must be over 26 years of age and possess a valid, unendorsed driving license with a minimum of 2 years driving experience.
9. As fuel is not included in the rental rate, rental vehicles will be issued with a nominal level of fuel (premium unleaded) upon Check-out and should be returned with the equivalent amount upon Check-in. Hirers may request for a full tank of fuel at the time of booking and will be charged for the fuel cost plus a 20% surcharge.
Terms of booking on this website
The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a vehicle supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.
When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.
While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.
Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed.
A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.
If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:

To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
The alteration fee will not be charged if your alteration request is not possible.
Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.
